- The OAG enforces New York's price gouging statute, section 396-r of the New York General Business Law, which prohibits unconscionably excessive pricing of necessary consumer goods and services during any abnormal disruption of the market. During this COVID-19 outbreak, this applies to necessary consumer goods such as hand sanitizers and other disinfecting products, toilet paper and basic food items. Given the volume of complaints we are receiving, we are unable to acknowledge receipt of your individual complaint at this time.
Because the Center for Disease Control (CDC) and Surgeon General recommend that individuals wear “cloth face coverings” that consumers can make on their own, and not surgical masks or N-95 respirators, face masks are not being considered as subject to the state price gouging statute. If you purchased a face mask from a New York City retailer, you can file a complaint with the NYC Department of Consumer Affairs (DCA), which recently adopted a temporary emergency rule making it illegal to drastically increase prices of certain items in shortage. To file a complaint with the DCA, or for a complete list of items covered by NYC's emergency regulation, go to https://www1.nyc.gov/site/dca/media/Face-Masks-in-Short-Supply-Due-to-COVID-19.page - Complaints filed with the Attorney General's Office are subject to public disclosure.
